1. About these Terms
These Terms form a binding agreement between you and unleashed.host when you access the site, create an account, place an order, or use any hosted service. By using the service, you confirm that you are legally able to enter into this agreement and that you will comply with these Terms, the Acceptable Use Policy, and any service-specific order details shown at checkout.
2. Trader Identity
For services sold through this site, the trader is Kevin Gorniak, a sole trader operating in the United Kingdom under the trading name unleashed.host. Where you need to send a legal notice or formal privacy-related query, use legal@unleashed.marketing. If a service-specific invoice or order form states a different contracting party, that document governs for that order.
3. Services
We provide infrastructure and management tools for game server hosting, Discord bot hosting, and related support services. Features, resource allocations, prices, and service characteristics are those shown on the applicable order page or invoice. We may improve, modify, or retire features where reasonably necessary for security, legal compliance, capacity management, or service quality.
4. Accounts and Orders
- You must provide accurate, complete, and current account and billing information.
- You are responsible for all activity under your account and for keeping your credentials secure.
- You must promptly notify us if you believe your account has been compromised or misused.
- Orders are accepted when we provision the service, issue an invoice, or otherwise confirm activation.
5. Billing, Renewal, and Suspension
- Fees are payable in advance unless your order form states otherwise.
- Recurring services renew automatically for the same billing period unless cancelled before renewal.
- We may suspend or restrict services for overdue invoices, chargebacks, fraud checks, security incidents, or policy breaches.
- You remain responsible for all charges incurred before cancellation or suspension takes effect.
6. Consumer Rights
If you are a consumer in the United Kingdom, nothing in these Terms excludes or limits rights that cannot lawfully be excluded, including your rights under the Consumer Rights Act 2015. Where a service is supplied digitally and starts during a cooling-off period at your express request, you acknowledge that cancellation rights may be reduced or lost once performance has begun to the extent permitted by law and clearly disclosed at checkout.
7. Acceptable Use and Customer Content
You must use the service lawfully and in accordance with our Acceptable Use Policy. You are responsible for all data, software, mods, scripts, bots, media, and other content you upload, store, run, or transmit through the service. You must have the rights needed for that content and for any software licenses used with your service.
8. Backups, Availability, and Support
- Any backups we provide are a convenience feature and do not replace your own backup obligations.
- Service availability can be affected by maintenance, upstream failures, attacks, third-party dependencies, and events outside our reasonable control.
- We may perform maintenance and emergency actions needed to protect infrastructure, users, or the network.
- Support is provided through the channels we make available, including the client area where applicable.
9. Intellectual Property
We retain all rights in the site, client area, branding, software, and service materials we provide, except for third-party components licensed to us or to you. You retain rights in your own lawful content, but grant us the limited rights reasonably needed to host, process, transmit, back up, secure, and support that content for service delivery.
10. Termination
You may cancel recurring services through the client area or any cancellation process we provide. We may suspend or terminate services immediately for serious policy breaches, illegal activity, non-payment, abusive behaviour, or material risk to the platform or other users. After termination, we may delete hosted content and configurations in line with our retention practices unless we are legally required to keep them.
11. Liability
We do not exclude or limit liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under English law. Subject to that, we are not liable for indirect or consequential losses, loss of profit, loss of revenue, loss of goodwill, or loss of data arising from your use of the service. To the fullest extent permitted by law, our aggregate liability relating to a service is limited to the fees paid by you for that service in the three months before the event giving rise to the claim.
12. Changes to the Service or Terms
We may update the service, prices, or these Terms from time to time. Where a change materially affects you, we will take reasonable steps to notify you before it takes effect, such as via the website, client area, or email. Continued use after the effective date means you accept the updated Terms.
13. Governing Law and Jurisdiction
These Terms and any dispute or claim arising out of or in connection with them are governed by the laws of England and Wales. If you are a business, the courts of England and Wales have exclusive jurisdiction. If you are a consumer, you may also have the right to bring proceedings in the part of the United Kingdom where you live.
